Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioner seeking quashing of FIR No. 0322/2024 registered under Sections 279/338A IPC and Sections 134/187 of MV Act at P.S. Civil Lines and all the proceedings emanating therefrom in terms of Memorandum of Settlement dated 06.10.2025. 2.

It is submitted that the Respondent No. 2/Complainant has suffered a fracture of his leg on account of road accident caused by the Petitioner while driving his car. The Petitioner after causing accident, had fled away from the sport for which offence under Section 187 MV Act was added. 3.

The parties are present in the Court and are identified by their respective Counsel. The parties submit that the matter has been compounded amicably in terms of Memorandum of Settlement dated 06.10.2025. 4.

The Respondent No. 2 has got a compensation of Rs.2.5 lacs from MACT. In addition, the Petitioner has paid Rs.50,000/- by way of Demand The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Draft bearing No. 321082 dated 01.12.2025 drawn on State Bank of India in favour of the Respondent No. 2 for amicable settlement of all the disputes, which is accepted by the Respondent No. 2.

The parties have endorsed the amicable settlement and accepted the terms thereof voluntarily and they submit that the said Settlement has been arrived at between the parties, without any pressure and coercion and that they shall remain bound by the terms of the settlement. 6.

In view of the above facts that the parties have amicably resolved their differences out of their own free will and without any coercion, no useful purpose will be served in continuing with the proceedings, rather the same would create further acrimony between them. Hence, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto.

Moreover, there is no legal impediment in quashing the FIR in question.

Accordingly, considering the totality of circumstances and the fact that they have settled the matter vide Memorandum of Settlement dated 06.10.2025, the FIR No. 0322/2024 registered under Sections 279/338A IPC and Sections 134/187 of MV Act at P.S. Civil Lines and all the consequential proceedings emanating therefrom, are quashed. 9.
