By this petition the petitioner seeks quashing of FIR No.371/2017 under Section 135 of the Electricity Act registered at PS Govindpuri, Delhi on the complaint of officer of Respondent No.2 on the ground that the parties have settled the matter.

Issue notice.

Learned Additional Standing Counsel for State and learned counsel for respondent No. 2 accept notice.

Learned counsel for respondent No.2 on instructions from Mr.Pradeep Basoya, Assistant Manager (Legal) of respondent No.2, who is present in Court and is identified by learned counsel, states that the respondent No.2 has settled the matter with the petitioner as the petitioner had paid a sum of ₹82,000/- in discharge of his liability.

Mr. Pradeep Basoya, Assistant Manager (Legal) of respondent No.2 states that he is authorized and competent to make a statement on behalf of respondent No.2. He further states that the respondent No.2 has settled the matter with the petitioner and in lieu of the payment made by the petitioners, 'No Dues' certificate has already been issued to the petitioner copy whereof is at page 29 of the paper book. He states that the respondent No.2 does not wish to pursue the above noted FIR and the proceedings pursuant thereto.

Petitioner who is present in Court and is identified by the learned counsel affirms the statement of Mr.Pradeep Basoya, Assistant Manager (Legal).

Since parties have settled the matter of their own free will and volition, it would be in the interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.

Consequently, FIR No.371/2017 under Section 135 of the Electricity Act registered at PS Govindpuri, Delhi and proceedings pursuant thereto are hereby quashed.

Parties have signed this order sheet in acknowledgment of their statements made before this Court.

Petition is disposed of. Order dasti.
