The instant matter was taken up yesterday i.e., on 16.10.2025 and after briefly hearing learned counsel appearing for the parties, hearing was deferred to enable them to make their further submissions. 2.

During the course of hearing and in view of the facts and situations, the parties, without going into the rival contentions, agree to resolve all their past and present disputes with the following terms: i.

It is agreed between them that the petitioner shall pay a consolidated sum of Rs.1 Crore, plus applicable taxes (in equivalent euros), out of which Rs.42 Lakhs, shall be paid within a period of two working days from today and remaining amount of Rs.58 Lakhs shall be paid within a maximum period of 30 days from today, towards the one year license fee for using SAS analytics Pro (on SAS 9.4), 4 core license. ii.

Necessary invoices, pursuant thereto, shall be raised by the respondent immediately.

iii.

The respondents shall ensure to provide all the applicable services/ features attached to the 4 core license software to the petitioner. 3.

To further clarify, the parties have agreed for substituting of the 2 virtual processor core appearing at column Nos.1and 2 with 4 virtual processor cores.

In view of the aforesaid, the 'Order Form' annexed as Document P13, shall now read as under: Offering Pricing Metrics, Quantity and other Usage Parameters Operating System Initial Fees Renewal Begin Date Anniversary Date SAS Analytics Pro (on SAS 9.x) Virtual Machine (4 Virtual Processor Cores) WX6S 18.10.2025 17.10.2026 Payable as per paragraph 2(i) of the present order SAS/ Access Interface to PC Files Virtual Machine (4 Virtual Processor Cores) WX6S 18.10.2025 17.10.2026 5.

Furthermore, all remaining terms and conditions shall remain intact as had already been agreed between them. The parties shall abide by the aforenoted agreement.
