None is present on behalf of the Appellant.

Learned counsel for the Respondent submits that CM(M) No. 2438/2025 whereby the Appellant has challenged the dismissal of the objections in the Execution Petition No. 2459/2025, while withdrawing his objections, has given an undertaking to vacate the premises on or before 28.02.2026. The Co-ordinate Bench of this court vide Order 20.12.2025 while permitting the objection to be withdrawn and given the time to the Appellant, to vacate the premises on or before 28.02.2026 failing which, the Respondent was at liberty to continue with the execution proceedings. 3.

In view of the aforesaid, the Appeal, as well as, the Applications, are dismissed in default and for non-prosecution.
