This is a writ petition under Article 226 of the Constitution of India read with Section 528 of BNSS (erstwhile Section 482 of CrPC) seeking quashing of the modification request rejection order No.

F.10 (3580864)/CJ/Legal/PHQ/2024/6761 dated 01.10.2024 and release of the petitioner on furlough for two weeks on furnishing cash surety of Rs. 10,000/-.

The petitioner was granted furlough on 31.07.2024 subject to furnishing a surety of Rs.10,000/- and a personal bond. Since the petitioner was unable to furnish surety to the tune of Rs.10,000/-, the petitioner moved an application seeking modification of that condition and undertaking to pay Rs. 10,000/- as cash security.

The same was rejected vide impugned order dated 01.10.2024. 4.

For the said reasons, issue notice. Mr. Bhandari, learned ASC accepts notice and states that in case the petitioner deposits Rs.10,000/- with the Jail The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Superintendent as a condition for grant of furlough for a period of 2 weeks, the same should be allowed.

Hence, the petition is allowed.

The modification request rejection order No.

F.10 (3580864)/CJ/Legal/PHQ/2024/6761 dated 01.10.2024 is set aside and the petitioner is directed to be released on 2 weeks furlough on depositing Rs.10,000/- and a personal bond with the Jail Superintendent. 7.

All other terms and conditions of the order No.

F.10(3580864)/CJ/Legal/PHQ/2024/5851 dated 31.07.2024 shall remain unaltered. 8.

The petition is disposed of accordingly.
