BAIL APPLN. 4116/2024 By way of the present petition filed under section 483 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks extension of interim bail granted vide common order dated 14.10.2024 made in BAIL APPLN. No. 3652/2024 and BAIL APPLN. No. 3697/2024 in case FIR No.172/2023 dated 01.07.2023 registered under sections 21/29/61/85 of Narcotic Drugs and Psychotropic Substances Act, 1985 at P.S.: Special Cell, Delhi. 2.

Quite apart from the fact that vide order dated 23.09.2024 made in BAIL APPLN. No.3418/2024 this Bench has already taken a view that a prayer for extension of interim bail must be filed in the original bail petition, in which the interim bail was first granted and not by BAIL APPLN. 4116/2024 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. way of a fresh substantive bail petition, it also transpires that the petitioner has failed to comply with para 10 of order dated 14.10.2024 inasmuch as that order had directed that if the surgery of the petitioner's wife (which was then scheduled on 16/17.10.2024) does not take place on the said dates or within 01 week thereafter, the petitioner was to surrender back to custody. Evidently, the petitioner has not done so.

In view thereof, the present petition stands dismissed, directing the petitioner to surrender to custody by day after tomorrow i.e., 15.11.2024.
