These applications are filed on behalf of the Petitioners under Section 151 CPC for early hearing of these writ petitions, which are listed on 08.12.2025.

For the reasons stated in the applications, the same are allowed and disposed of and the writ petitions are taken up for hearing today, with the consent of the parties.

These writ petitions are filed on behalf of the Petitioners under Article 226 of the Constitution of India for quashing the decision taken by SRC, NCTE in its 468th Meeting held on 28.07.2025 as being beyond the scope of NCTE Act, 1993 and Regulations framed thereunder as also being violative of Articles 14 and 19(1)(G) of the Constitution of India. Direction is sought to SRC, NCTE to decide the applications of the Petitioners seeking permission for shifting the premises of the respective colleges in terms of NCTE Regulations, 2014 in a time bound manner. As common question of law is raised in all the writ petitions, they are being decided by this common order.

The primordial issue raised by the Petitioners in these writ petitions is whether applications seeking shifting of premises should mandatorily be accompanied with NOC of the concerned State Government. learned counsel for the Respondents, on instructions, fairly and candidly submits that no NOC is required to be submitted by the colleges/institutions for seeking approval to shift the premises within the same State and that orders have been passed by this Court allowing similar writ petitions holding that NOC is not required.

In light of the stand taken by the Respondents and having perused the order dated 25.09.2025 passed in similar writ petition being W.P.(C) No. 11974/2025, whereby the writ petition was allowed by the Court with a direction to process the application of the Petitioner, recording the stand of NCTE that there was no requirement for furnishing NOC from the State Government in terms of NCTE Regulations, 2014, these writ petitions are allowed. Respondents are directed to consider the applications of the Petitioners after inspecting the concerned premises and to take a decision thereon within 10 days from today, considering that the counselling shall come to an end at the end of November, 2025.

No further orders are called for and the writ petitions are disposed of along with pending applications.
