Learned counsels for the parties' state that a Settlement Agreement dated 06.05.2025 has been executed between the parties. They state that the said Settlement Agreement has been e-filed today with the registry. 2.

It is stated that the said Settlement Agreement dated 06.05.2025 has been accepted by the Division Bench in FAO (OS) (COMM) 05 of 2025 and the appeal has been disposed of in terms thereof vide order dated 07.05.2025.

Learned counsels for the parties' state that the present suit be also disposed of in terms of the said Settlement Agreement. 4.

Learned counsel for the Plaintiff states that in view of the amicable settlement of disputes in this suit, the direction issued to the Plaintiff to pay ad-valorem Court fees vide judgment dated 22.11.2024 be waived. 5.1.

He states on instructions that the Plaintiff undertakes to deposit costs of Rs. 1 lakh in favour of Shaurya Foundation (Shaurya Foundation Trust, UCO Bank, Delhi High Court, Shershah Road, New Delhi-110001; Account No.: 15530210000793; RTGS/NEFT IFA CODE: UCBA0001553) within two (2) weeks.

In view of the Settlement Agreement dated 06.05.2025 and the submissions of the parties, the present suit is disposed of. 7.

The direction issued to the Plaintiff to deposit ad-valorem Court fees vide judgment dated 22.11.2024 is waived, keeping in view the mandate of Section 16 of the Court Fees Act, 1870.

The submission of the Plaintiff that it will deposit costs is taken on record and it is bound down to the same. The Plaintiff will deposit the receipt evidencing deposit of cost within three (3) weeks. In case, the costs are not deposited, registry is directed to list this matter before this Court. 9.

The Defendant is bound down to its undertaking recorded in the Settlement Agreement dated 06.05.2025.

Pending applications stand disposed of.

All future dates stand cancelled.
