This is a petition filed under Section 483 BNSS (erstwhile Section 439 CrPC) seeking grant of regular bail to the petitioner in FIR No. 258/2024 under Sections 420/467/471 IPC registered at P.S.: Krishna Nagar. The chargesheet has been filed under Sections 420/467/468/471/34/120B IPC.

As per the allegation, the petitioner along with the co-accused stated that the bill of Rs. 4.1 lakhs received by the complainant from BSES would be settled by the petitioner for a sum of Rs. 1.7 lakhs (Rs. 1.3 lakhs to be paid to BSES and Rs. 40,000/- to the petitioner). 3.

Thereafter, on making the said payment by the complainant, the petitioner showed a forged order of the PLA-II showing that the bill has been settled.

In the present case, the petitioner is in custody since 26.06.2024. 6.

The investigation has been completed and charge sheet has been filed. 7.

The petitioner is the sole earning member of the family comprising of aged parents and an unwell wife.

In addition, the petitioner has clean antecedents and besides the present case, there is no other criminal case pending against the petitioner. 9.

For the said reasons, the petition is allowed and the petitioner is directed to be released on regular bail in FIR No. 258/2024 registered at P.S.: Krishna Nagar subject to the following terms and conditions: (a) The applicant shall furnish a personal bond in the sum of Rs. 10,000/- (Rupees Ten Thousand Only) with one surety of the like amount to the satisfaction of the concerned Trial Court; (b) The applicant shall join investigation as and when called by the concerned IO, and the applicant shall appear before the concerned Court as and when the matter is taken up for hearing; (c) The applicant shall provide his mobile number to the concerned IO, which shall be kept in working condition and switched on at all times. In case of change of residential address or contact details, the applicant shall promptly inform the same to the concerned IO as well as to the concerned Court; (d) The applicant shall report to the local Police Station on the first Monday of every month;

(e) The applicant shall not leave the country without permission of the concerned Court during the bail period and surrender his passport, if any, at the time of release before the concerned The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
