W.P.(C) 1828/2016 & CM Appl. 7871/2016 The present writ petition has been filed challenging the impugned decision dated 09th -12th December, 2015 of NRC whereby petitioners' application for grant of recognition for D.El.Ed. course for the academic session 2016-17 was refused on the ground that the petitioner-institute did not give any reply to the show cause notice issued by the respondent.
Learned counsel for the petitioners states that the petitioners were never served with any show cause notice issued by the NRC.
However, the said fact in the present case is a disputed question of fact.
In any event, since the petitioners have a remedy by way an appeal, this Court is not inclined to entertain the present writ petition. At this stage, learned counsel for the petitioners states that he would like to withdraw the present writ petition with liberty to file an appeal to the NCTE. He only prays that the NCTE be directed to expeditiously dispose of the appeal to be filed by the petitioners. With the aforesaid liberty, the present writ petition and application are disposed of with a direction that in the event, the petitioners file an appeal on or before 05th March, 2016, the NCTE shall make an endeavour to dispose it of in its next meeting which is proposed to be held on 19th March, 2016.
