This is a writ petition filed under Article 226 of the Constitution of India read with Section 528 BNSS (erstwhile Section 482 CrPC) seeking premature release of the petitioner in FIR No. 313/2002, PS Keshav Puram, Delhi on the ground that the petitioner has already undergone incarceration for an actual period of 17 years and 6 months, and 20 years and 6 months with remission.

It is stated that the petitioner was sentenced to life imprisonment. 3.
Issue notice. Mr. Bhandari, learned ASC states that the case of the petitioner has been considered by the Sentence Review Board on 18.09.2024 under the 2004 Policy and the decision is expected within the next 8 weeks. 4.
Since the case of the petitioner is being considered by the Sentence Review Board, the petition at this stage is premature. 5.
