This Petition has been filed under Section 11(6) of the Arbitration and Conciliation Act, 1996 seeking appointment of an Arbitrator to adjudicate upon the disputes which have arisen between the parties under the Agreement dated 08.06.2021.

It is stated that under the said Agreement, the Petitioner herein was entrusted with the work of improvement of road on left bank of Mungeshpur Drain from RD 7610m to RD 10362m . It is stated that disputes arose between the parties on the issue of release of amount due and payable to the Petitioner. It is stated that Clause 25 of the Agreement contains Dispute Resolution Clause wherein the Petitioner has already exhausted the remedy of attempting to amicably resolve their inter-se disputes.. It is stated that Clause 25 of the Agreement also contains an Arbitration Clause which The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
provides that if the DRC is unable to resolve the disputes between the parties under the Agreement, the disputes shall be decided by means of Arbitration and the seat of Arbitration shall be Delhi. It is stated that Notice under Section 21 of the Arbitration Act was issued by the Petitioner on 28.04.2025 which has not been replied to by the Respondent. The Petitioner has, therefore, approached this Court by filing the present Petition. 3.
In view of the fact that disputes have arisen between the parties and other mechanisms of dispute resolution have been exhausted by the Petitioner and also in view of the fact that there is a valid arbitration clause in the Agreement, this Court is inclined to appoint an Arbitrator to adjudicate upon the disputes between the parties. 4.
Accordingly, Ms. Carina Arora, Advocate (Mob: 9953427159) is appointed as the Sole Arbitrator to adjudicate upon the disputes between the parties.

The arbitration would take place under the aegis of the Delhi International Arbitration Centre (DIAC) and would abide by its rules and regulations. The learned Arbitrator shall be entitled to fees as per the Schedule of Fees maintained by the DIAC.

The learned Arbitrator is also requested to file the requisite disclosure under Section 12(2) of the Arbitration & Conciliation Act within two weeks of entering the reference.

All rights and contentions of the parties in relation to the claims/counter-claims are kept open, to be decided by the learned Arbitrator on their merits, in accordance with law.

Needless to say, nothing in this order shall be construed as an expression on the merits.
