This is a petition filed under Section 11 of the Arbitration and Conciliation Act, 1996 ("Act") seeking appointment of an arbitrator arising out of a Fax of Acceptance awarding the work to the petitioner on lump sum turn key basis for LPG storage & dispatch facilities and offsite & utilities at Bongaigaon Refinery, Assam, Indiadated 23.02.2017. 2.

A perusal of the paper book shows that no notice under Section 21 of the Act has been issued.

Mr. Gaggar, learned senior counsel for the petitioner, on instructions, seeks to withdraw the petition and file a fresh petition after serving the notice under Section 21 of the Act.
