Petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as „B.N.S.S.') or in alternate under Section 482 of the Code of Criminal Procedure, 1973 (hereinafter referred to as „Cr.PC‟), has been filed on behalf of the Petitioner, Prabhmeet Singh for quashing of FIR No. 694/2024 under Section 279/337 of the Indian Penal Code, 1860 (hereinafter referred to as „IPC') registered at Police Station Moti Nagar and all the consequential proceedings emanating therefrom, in terms of the mediated Settlement dated 04.06.2024.

On advance Notice, learned ASC has appeared and accepted the Notice on behalf of the State.

Brief facts of the case are that on 12.12.2023, at 08:20 to 08:30 pm, victim Mr. Jagdish Parshad, aged 70 years, was crossing the road on Moti Nagar, New Delhi, when traffic was moving and got hit by the Petitioner herein, who was driving a scooter/scooty. Upon impact, victim lost his balance and fell on the road. Ambulance was called by one passerby while Petitioner assisted the victim to settle. The ambulance came and Petitioner helped victim to get inside the said ambulance and the said ambulance took the victim to ESI Hospital, Moti Nagar. On 22.12.2023, victim, Jagdish Parshad unfortunately died while treatment was going on. He survived by his wife, Ms. Urmila Devi, son, namely, Kamal Saini and one daughter, namely, Ms. Ritu, However, the daughter in the mediated settlement has given a Statement that she is not claiming any compensation. 5.

On the Complaint of the Respondent No.2/Complainant, FIR No.694/2024 under Section 279/337 of IPC, got registered at Police Station Moti Nagar.

It is stated that the Petitioner and the Respondent No. 2 and 3 have amicably settled all the disputes and differences between them and arrived at Settlement dated 04.06.2024. In the Settlement, it was inter alia settled between the parties that the Petitioner shall pay Rs.7.5 Lakhs to the Respondents, towards full and final Settlement, in three equal instalments amounting to Rs.2,50,000/-, by way of DD and RTGS. 7.

It is stated that the Petitioner has already paid the settled amount to the Respondent Nos. 2 and 3/Complainants.

state that they have received all amounts due to them and have no objection if the said FIR is quashed.

The parties are present before this Court in-person today, and have been identified by their Counsel and Investigating Officer concerned and they have entered into the Settlement voluntarily and without any fear and coercion and undertake to remain bound by the terms of the said Settlement. 10.

Considering the nature of the allegations and that they have settled the matter, the FIR No. 694/2024 under Section 279/337 of IPC, registered at Police Station Moti Nagar and all the consequential proceedings emanating therefrom are quashed, 11.

The Petition is disposed of accordingly.
