This petition has been filed seeking quashing of FIR No.325/2019 registered at P.S. Janak Puri, under Sections 498A/406/34 IPC, on the basis of settlement dated 4th November, 2022 arrived at between the parties. 2.
As per the settlement, amounts which have been agreed to, have already been paid to Respondent No.2 and the same is confirmed by Respondent No.2 who is present through video conferencing and has been duly identified by Investigating Officer and her counsel. 3.
Petitioners No. 1 and 2 also appear through video conferencing and have been duly identified by IO and their counsel. Respondent No.2 has no objection to the quashing of the FIR.

The marriage of Petitioner No.1 and Respondent No.2 has resulted in divorce by decree dated 24th May, 2024. One female child was born from the wedlock.

Considering the above settlement between the parties and the chances of conviction of the petitioners being remote and bleak, there is no use continuing with proceedings of the present FIR as it would be a misuse of the process of the Court and an unnecessary burden on the State exchequer. Accordingly, the petition is allowed. Consequently, the FIR No.325/2019 registered at P.S. Janak Puri, under Sections 498A/406/34 IPC and proceedings emanating therefrom are quashed.

Parties shall abide by the terms of settlement. 7.
Accordingly, petition is disposed of. Pending application also stands disposed of as infructuous.

It is however made clear that the said settlement will not affect the rights of the minor child in future.
