By way of present petition, the petitioner seeks setting aside of the order dated 15.05.2024 passed by the learned ACMM (Special Acts), District Central, Tis Hazari Court, Delhi in CT Case No.288799/2016 titled as 'ESPEE Trading Corp. Ltd. v. Rama Paper Mills Ltd.' as well as restoration of the said complaint.

From the facts narrated in the petition, it is apparent that vide judgment dated 20.12.2023 passed in Crl.M.C. Nos. 3761/2017 and 3765/2017, a Coordinate Bench of this Court quashed the complaint as well as the summoning order against the petitioners. Later, vide order dated 19.07.2024 passed in Crl. M.A. 16731/2024 and Crl. M.A. 16735/2024, on the applicants seeking clarification, it was clarified that the judgment was only qua the petitioners therein who had approached this Court. 3.

In view of the above, learned counsel for the petitioner, upon instructions, seeks leave to withdraw the present petition with liberty to approach the Trial Court for the aforesaid clarification.
