Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.'), has been filed on behalf of the Petitioner, seeking quashing the FIR No. 785/2016 dated 23.10.2016 under Section 3, 4 of Gambling Act, 1955 registered at Police Station Neb Sarai, District South, Delhi and the consequential proceedings arising thereof in Case bearing No. CR. Cases/4039/2017 of learned Chief Judicial Magistrate, District south, Saket Courts, Delhi.

Learned Prosecutor has taken serious objection to the Petition on the ground that the delay is exclusively attributable to the Petitioner. There were 22 Petitioners, who had time and again, been filing the Revision Petition. 3.

Learned counsel for the Petitioner fairly concedes that they had even filed Revision Petition against the Order of cognizance, on the ground of limitation but the same got dismissed.

There is no merit in the present Petition. Considering that the matter is still pending at the stage of arguments on Charge, the Petition is disposed of with liberty to the Petitioner, to raise his contentions at the time of framing of Charge or to avail any other statutory remedy which may be available to the petitioner and further directions that the learned Trial Court shall not adjourn the matter on the fixed date and would hear the matter and pass appropriate Order. Pending Applications, if any, also stand disposed of.
