O R D E R

% 04.03.2016 Mr. Kundu, learned Additional Standing Counsel (Criminal) appearing on behalf of the State, on instructions from the IO SI Hawa Singh Yadav, Police Station- Najafgarh, Delhi states that in view of the circumstance that the petitioners are a newly-wed couple, who are apprehending threats at the hands of the family of petitioner No.1, the police would afford adequate protection to them. The beat constable of the concerned area shall also be sensitized in this behalf. The telephone number of the SHO of the concerned police station as well as the beat constable shall be provided to the petitioners in order to enable the latter to contact the former in the event of any threat or apprehension. Directed accordingly.

At this stage, it is also brought to my notice that an FIR has been registered on a complaint instituted at the instance of the brother of petitioner No.1 (respondent No.4 herein) under Section 365 IPC, against petitioner No.2 herein.

The petitioner no.1, who is present in person in Court today and has been identified by the IO SI Hawa Singh Yadav, Police Station- Najafgarh states that

she is an adult and has married petitioner No.2 of her own free will on 25.02.2016 and left her parental home of her own accord. In this view of the matter, Mr. Kundu states that it would be imperative to get a statement of Rinku, petitioner no.1 herein, recorded under Section 164 of the Code of Criminal Procedure, 1973, before a Court of competent jurisdiction. On instructions from Rinku, the petitioner no.1 herein, counsel appearing on behalf of the petitioners states that they shall accompany the IO in the subject FIR, who is present in Court today, to the Court of competent jurisdiction for recording of the aforesaid statement.

With the above directions, the writ petition is disposed of. A copy of this order be given dasti under the signature of Court Master to counsel for the parties.
