Petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagrik Suraksha Sanhita, 2023 ("BNSS") has been filed on behalf of the Petitioners for quashing of Summoning Order dated 15.01.2020 and all consequential proceedings emanating therefrom arising out of CC No.19642/2019 under Section 138 NI Act. 2.
It is submitted in the Petition that summons were directed to be issued vide Order dated 15.01.2020. Non-Bailable Warrants, for the first time, which were issued vide Order dated 28.03.2024 and thereafter, vide Order dated 21.10.2024, proceedings under Section 82 Cr.P.C. were initiated. 3.
Petitioner on coming to know about coercive process issued against him, moved an Application on 09.07.2025 for cancellation of Non-Bailable Warrants. Despite being aware of the present Complaint, it is only now when the present Petition has been filed to challenge Summoning Order dated 15.01.2020. This Order is amenable to revisional jurisdiction before the Court of learned ASJ.
