% 14.09.2016 Petitioner before this Court is stated to be the widow of Bhoop Singh. Bhoop Singh had admittedly died on 15.01.2009. He was stated to be squatting from Defence Colony Market, opposite Municipal Corporation Primary School, Defence Colony, New Delhi. He got tehbazari site measuring 17'X 5' under handicapped quota. The petitioner before this Court claims to be the widow of Bhoop Singh. She has made a representation to the Department seeking substitution site qua the original person namely Bhoop Singh but her representation was rejected.

Counter affidavit states that as per the original record with the Department Bhoop Singh had left behind four sons (as was evident from the ration card filed with the Department). The contention of the petitioner (Maya Devi) before the Department is that she has two sons

namely, Manoj Kumar and Vinod Kumar. The Department had admittedly noted that (as per their original record) out of the four sons Manoj Kumar and Vinod Kumar were shown as sons of Bhoop Singh and they alone were her sons. The other two persons Guddu and Bali were employees of Bhoop Singh. Contention of the petitioner on this score is that Guddu and Bali were working with Bhoop Singh and being from the same village their names were endorsed in the ration card.

These submission which have been averred in the writ petition shall be considered by the Department on the petitioner assuring this Court that all relevant documents as required by the Department shall be furnished to the Department within an outer limit of four weeks from today. The vehement contention of the petitioner that apart from the petitioner Maya Devi no other person is claiming any site against the squatting site shall also be considered while answering this representation.

Petition disposed of in the above terms.
