% 19.01.2026 REVIEW PET. 612/2025 1.

The present review petition has been filed by the original appellant seeking review of the order and judgment dated 10th November, 2025, to the extent of the award of interest, including pendente lite and post-award interest.

It is not in dispute that the appellant is liable to pay interest and pursuant to the statutory mandate under Section 31(7)(b), such interest is payable at a rate of 2% over and above the current rate of interest charged by nationalised banks.

If that be so, the appellant is liable to pay interest over and above 10%, whereas the respondents are agreeable to accept interest at the rate of 9%, as awarded, which is otherwise the rate claimed by them in the demand notice. 4.

Though the order was set aside, however, the interest awarded in the earlier round was at the rate of 9% only.

In that view of the matter, we deem it appropriate to direct the appellant to pay pendente lite interest so also the post proceedings interest at the rate of 9%.

In response to the Court's query, we are informed that in any case, the amount shall be paid to the respondent within a period of eight weeks. The statement is accepted.

The review petition, accordingly, stands allowed to the aforesaid extent.
