The present petition filed under Article 226 of the Constitution of India, 1950 read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 seeks joint quashing of FIR No. 241/2023 registered under Sections 288/304A of the Indian Penal Code, 1860 at P.S. Delhi Cannt. 2.

Counsel for Petitioner states that since the Petitioner is unable to contact Respondents No. 3 to 5, who are the legal representatives of the deceased, he is not pressing the relief sought in the present petition, as it was premised on a compromise arrived at between the Petitioner and Respondents No. 3 to 5.

He further submits that as per the Compromise Deed dated 2nd August, 2023, Respondents No. 3 to 5 agreed to quash the present proceedings which is also evident from the no-objection affidavits of the said Respondents. In such circumstances, counsel for Petitioner states that he would like to withdraw the present petition.

Accordingly, the present petition is dismissed as withdrawn. 6.

It is clarified that the Court has not examined the merits of the case and all rights and contentions of the parties are left open.
