On 11th July, 2024, this Court while deciding W.P.(C) 16328/2023, had specifically directed the Respondent to pass a speaking order on the Petitioner's representation dated 14th December, 2023 within one month from the date of the order. In compliance of the Court's direction, the Respondent has passed order dated 29th October, 2024, to the following effect:

In the opinion of the Court, the afore-noted order fails to comply with order dated 11th July, 2024 in W.P. (C) 16328/2023, which specifically directed the Respondent to pass a speaking order, requiring the SubRegistrar to consider the Petitioner's contentions, examine the legal position, and provide reasons for the decision, enabling the parties to understand the basis of the conclusion drawn. However, the impugned order is merely a one-line conclusion by the Respondent, without any reasoning or explanation to support the decision.

In light of the above, the impugned order dated 29th October, 2024 is set aside. The matter is remanded back to the Respondent with a clear direction that a speaking order would be passed in line with the observations made hereinabove within four weeks from today. 4.

Accordingly, the present petition, along with pending application, is disposed of.
