% 23.10.2017 The counsel representing the appellant insurance company submits, on instructions that in view of the judgment dated 28th January, 2016, in connected MAC Appeal Nos. 487-89/2011 ICICI Lombard General Insurance Company Ltd. vs. Saraswati Devi & Ors., he may be allowed to withdraw the appeal.

The appeal is dismissed as withdrawn.

By order dated 26th May, 2011, the insurance company had been directed to deposit the entire awarded amount with upto date interest and out of such deposit fifty per cent (50%) was allowed to be released to the claimant. The balance shall also now be released to the claimant in terms of the impugned judgment of the Tribunal.

The statutory amount shall be refunded.
