O R D E R

% 09.03.2017 Petitioner seeks parole for three months on the ground of arranging finances for the education of his children and also to re-establish social ties with the family members and society. Address of the petitioner has been verified by the State. Learned Additional Standing Counsel submits that it was the case of triple murder committed at the time of robbery, therefore, petitioner is not entitled to parole, in terms of Clause 12.5(c) of the Parole/Furlough Guidelines, 2010. Petitioner is in jail for about four years. His jail conduct is satisfactory.

It is trite law that a convict in continuous incarceration, if released on

parole at least once a year, it aids to his physical and mental well being. Earlier also, petitioner was released on parole from 11th April, 2016 to 9th May, 2016 for a period of four weeks. It is not the case that petitioner has misused the concession of parole extended to him on that occasion. Keeping in mind the totality of circumstances, it is ordered that petitioner be released on parole for a period of one month from the date of his release, subject to his furnishing personal bond in the sum of `10,000/- (Rupees Ten Thousand Only) with one surety in the like amount to the satisfaction of the Jail Superintendent. During the parole period, petitioner shall report to the SHO, PS. Lodhi Colony once a week, that is, on Mondays at 10:00 am and give his contact number to the SHO concerned. On completion of parole period, petitioner shall surrender before the Superintendent Jail.

Writ petition is disposed of in the above terms. Copy of the order be sent to the Jail Superintendent for serving it upon the petitioner and for compliance.
