% 01.10.2019 The petitioner has preferred the present writ petition to seek the following reliefs:
"a.
pass a writ order or direction in the nature of a writ of declaration, declaring the acquisition proceedings initiated in respect of the land of the petitioner, admeasuring 1158 sq. yds. out of khasra no. 730, situated in the revenue estate of Village Tuglakabad, Delhi, as deemed to have lapsed in view often provisions of The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013.
b.
further pass a writ, order or direction in the nature of a writ of mandamus thereby directing the respondents not to
interfere with the peaceful possession and enjoyment of the land admeasuring 1158 sq. yds. out of khasra no. 730, situated in the revenue estate of Village Tuglakabad, Delhi, and c.
pass such other or further orders as deem fit and proper in the circumstances of the case."
Evidently, the petition is barred by gross delay and laches inasmuch, as, the notification under Section 4 of the Land Acquisition Act was issued on 10.11.1960; the declaration under Section 6 of the said Act was issued on 04.01.1969; and the award was passed by the Land Acquisition Collector on 19.09.1986; whereas the present petition has been preferred only in March, 2018.
Learned counsel for the petitioner seeks leave to withdraw the writ petition with liberty to file afresh with proper explanation for the delay and laches.
