% 24.04.2018 The petitioners are aggrieved by some of the conditions/directions in the order dated 26.10.2017, whereby final decree in the suit was passed binding them with certain obligations. The appropriate remedy against such final decree would be by way of appeal under Section 96 of the Code of Civil Procedure, 1908 (CPC).

At this stage, the learned counsel for the petitioners submits that he may be allowed to withdraw the present petition and the applications filed therewith and instead be given liberty to approach the court by way of appeal under Section 96 CPC.

The petition and the applications filed therewith are dismissed as withdrawn with liberty as prayed for granted. R.K.GAUBA, J.
