This petition is for quashing of FIR No. 992/2006 lodged in P.S. Kalkaji, New Delhi and proceedings arising out therefrom. 2.

The complainant (respondent no.2) and accused (petitioner) have entered into a settlement deed on 16th February, 2018 which is a part of the record. It is recorded therein that a sum of Rs. 1.5 lakhs was to be paid by the petitioner to the complainant. Out of this amount, parties do not dispute that a sum of Rs. 50,000/- was paid in cash on 18.02.2018, and a further sum of Rs. 25,000/- was paid on 30.07.2018. A demand draft for the balance CRL.M.C. 1329/2018

amount of Rs. 75,000/- has been handed over to the learned counsel for the respondent no. 2 by the learned counsel for the petitioner in Court today, a copy whereof is hereby taken on record.

The petitioner and the respondent no.2 are present in Court. The I.O is also present and identifies the parties and confirms the contents of the application. The parties have confirmed before the Court that they have entered into the compromise of their free will and volition, and were not subject to any pressure or coercion.

In the circumstances, no further purpose would be served in keeping the criminal proceedings alive. Consequently, the petition is allowed and FIR No. 992/2006 lodged in P.S Kalkaji, New Delhi, and proceedings arising therefrom are quashed, subject to the petitioner paying costs of Rs. 10,000/- which may be paid to the Delhi Police Martyr's Fund.
