% 03.03.2017 W.P.(C) 1937/2017 C.M. No.8591/2017 Petitioner is aggrieved by the illegal and unauthorized construction which is being carried out by respondent no.3 at third floor of property bearing No.H-3/115 and 116, Sector-11, Rohini, Delhi. It is stated that this illegal construction is against all the byelaws of the Corporation. On advance notice, learned counsel for respondent no.1/North DMC has put in appearance. Her submission is that illegal deviations in the property already stood booked. A work stop notice has been issued to respondent no.3/occupier on 21.1.2017. Pursuant

to a demolition order passed on 23.01.2017 demolition programme has now been fixed for 06.3.2017. Learned counsel for respondent no.1 under instructions submits that the demolition programme shall be effectively carried out on that date as on earlier date it could not been carried out in the absence of the local police. The local police/SHO concerned has been arrayed as respondent no.2. The respondent no.2 shall give an adequate assistance to respondent no.1 at the time of execution of demolition programme or on any other date as and when so desired by respondent no.1. Learned counsel for respondent no.1 further informs this Court that respondent no.3 has also committed certain illegal construction as he has joined two properties i.e. H-3/115 and 116 which is against the DMC Act. Respondent no.1 is directed to take appropriate action against the property in accordance with law.

No further orders are called for.
