Heard learned counsel representing the parties at length. 5.

The learned Central Administrative Tribunal, Principal Bench, New Delhi, by order dated 16.01.2025, has directed the Petitioner to re-designate the respondent to the post of Public Health Inspector upon completion of 10 years in the grade, reckoned from the date of his appointment as an Assistant Public Health Inspector. 6.

The limited grievance of the Petitioner is that the post of Public Health Inspector is a promotional post from the post of Assistant The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Public Health Inspector. As per the Public Health Inspector Recruitment Regulation, 2017, there are two sources of recruitment to the post of Public Health Inspector, that is, by direct recruitment and by promotion. 75% of the posts are to be filled in by direct recruitment, whereas, 25% posts are to be filled in by promotion, failing which, by deputation including short term contract. 7.

Learned counsel representing the Petitioner submits that the direction issued by Central Administrative Tribunal should be substituted with direction to consider and not re-designate. 8.

She submits that the Petitioner's case is required to be considered by the competent authority, while examining as to whether the Petitioner is the senior-most Assistant Public Health Inspector and whether the vacancy in the promotional quota is available or not. 9.

Learned counsel representing the Respondent is unable to provide relevant information on the ground that these facts are exclusively in the domain of the Petitioner.

Keeping in view the aforesaid facts, directions contained in Para 4.6 of the impugned order are substituted and the Petitioner is directed to consider Respondent for promotion to the post of Public Health Inspector in accordance with rules within a period of two months from today.
