O R D E R

% 02.06.2016 (1) The petitioner seeks anticipatory bail under Section 438 Cr.P.C.in case FIR No.752/15 under Sections 406/420 IPC registered at Police Station Preet Vihar. Status report is on record. Response filed by the complainant is also on record.

(2) It was informed that a settlement had taken place between the parties whereby the petitioner had agreed to pay `42,00,000/- (Rupees

forty two lacs) to the complainant on the terms and conditions incorporated in the Settlement Deed (Annexure-4). By an order dated 30.11.2015, the Trial Court, however, directed the petitioner to deposit `42,00,000/- in the shape of FDR in favour of the concerned court within three weeks.

The petitioner did not comply the said order. It is informed that only `4,00,000/- (Rupees four lacs) have since been deposited by the petitioner.

(3) During the course of arguments, the petitioner agreed to pay all the instalments due upto 15.06.2016 excluding `4,00,000/- already deposited by him before the Trial Court within one month to the complainant. He further assured to pay remaining instalments on the scheduled dates. On this, the complainant's counsel has no objection to the grant of bail.

(4) Considering the facts and circumstances of the case and the settlement arrived at between the parties, the petitioner is admitted to anticipatory bail and in the event of his arrest, he be released on bail on his furnishing personal bond in the sum of `50,000/-with one surety in the like amount to the satisfaction of the SHO/Investigating Officer with the condition that he shall join the investigation as and when required.

(5) The amount due upto 15.06.2016 as reflected in the settlement (Annexure-4) after deducting `4,00,000/- shall be paid to the complainant within one month through the Investigating Officer. The remaining instalments shall be paid as and when they become due. The payment shall be without prejudice and subject to adjustment (if

any). `4,00,000/- deposited by the petitioner before the Trial Court in this FIR shall be released to the complainant. In case of noncompliance, the State/complainant will be at liberty to approach this Court.

(4) The bail application stands disposed of.
