Learned counsel for the petitioner states that pursuant to the conviction being upheld by the Division Bench of this Court which also recommended to the Government to consider the issue of suitability of permitting or reviewing petitioner's sentence in exercise of its power under the Constitution and the law, the petitioner filed a mercy petition before the President of India. According to the petitioner Hon'ble President of India rejected the mercy petition on 1st April, 2015. He states that since more than 3 years has lapsed after rejection of the first mercy petition, the petitioner would take further remedy by filing a fresh mercy petition for partition before the Hon'ble President of India and representation for remission W.P.(CRL) 1338/2016
before the Sentence Reviewing Board if permissible in law. 2.
The petitioner would be at liberty to take the remedies as available in law and in case the petitioner takes such remedy, the same will be decided uninfluenced by the earlier rejection by the Competent Authorities. 3.
In view of this statement of the petitioner and liberty granted, the petitioner does not press the other grounds and seeks leave to withdraw the present petition.

Petition is disposed of as withdrawn.
