Application under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'B.N.S.S.'), has been filed on behalf of the Petitioner, for early hearing in the accompanying Bail Application on the ground that the Petitioner intends to withdraw his Regular Bail Application.

Section 528 of BNSS, has been filed on behalf of the Petitioner, for grant of Regular Bail in FIR No. 820/2017 under Section 302/120B/34 of the Indian Penal Code, 1860 read with Section 25/54 of the Arms Act, registered at Police Station Mangol Puri.

On advance Notice, learned APP for the State has appeared and accepted the Notice.

It is submitted that the Petitioner/Applicant is seeking Regular Bail on the medical grounds of his mother and seeks permission to withdraw the Bail Application with liberty to file afresh before the learned Trial Court. 8.

In view of the submissions made, the Bail Application is permitted to be withdrawn with liberty as prayed for.
