This is an application filed on behalf of applicant, seeking grant of bail in case FIR No. 47/2025, under Sections 20(B)(II)(C)/25 of NDPS Act, registered at Police Station Crime Branch (West). 2.
Learned counsel appearing on behalf of applicant, submits that applicant is an innocent person with no criminal antecedents and he has been falsely implicated. He further submits that other three co-accused persons have since been enlarged on bail, and therefore, applicant is also entitled for grant of bail on the ground of parity.

The bail application has been opposed by learned APP appearing on behalf of State, stating that huge quantity of contraband has been recovered from the applicant, which falls in the category of "commercial quantity", and therefore, bar of Section 37 NDPS Act is applicable and thus, applicant The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. is not entitled for grant of bail. He further submits that other three coaccused persons have been granted bail, but no recovery has been affected from their possession, and therefore, applicant cannot claim parity on that account.

As per allegations, on the basis of a secret information, a trap was laid and applicant was intercepted near Raja Garden flyover and upon search of his vehicle, 156.742 Kgs of ganja was recovered. 5.
Admittedly, the alleged recovery falls in the category of "commercial quantity" and therefore, rigors of Section 37 NDPS Act shall apply in the present case. However, applicant has failed to overcome such rigors. 6.
The allegations against the applicant are grave and serious in nature. He cannot claim parity with other three co-accused inasmuch as there is no allegation of recovery of contraband from their possession. 7.
Hence, keeping in view the aforesaid facts and circumstances and considering the nature and gravity of allegations, as also the bar of Section 37 NDPS Act, the Court is not inclined to grant bail to the applicant/ accused. The application is, therefore, dismissed. 8.
A copy of this order be sent to the applicant/accused through Jail Superintendent.

It is clarified that nothing stated in this order shall tantamount as an expression on the merits of the case.
