The present application has been filed on behalf of the petitioner/applicant seeking interim bail for a period of one month in FIR No. 1475/2015 registered under Sections 302/34 IPC at P.S. Govind Puri, New Delhi on the ground that the applicant's elder brother Ved Parkash has passed away on 03.11.2024.

Learned counsel for the applicant states that the bail application has been accompanied by cremation receipt issued by Shamshan Ghat, Nehru Place, New Delhi. He further submits that the applicant is the only blood relative responsible for performing the last rites following the death of his elder brother. Lastly, it is stated that the applicant had earlier been released on account of HPC Guidelines during COVID-19, a concession which he did not misuse.

A Status/Verification Report has been handed over today by the State confirming that the factum of death of the elder brother of the applicant has been verified. It is further stated that inquiries made with the neighbours and the applicant's uncle confirm that he is the only blood relative of his deceased brother. The slip issued by the cremation ground also stands verified.

Considering the facts and circumstances of the case and that the factum of passing away of applicant's elder brother stands verified, it is directed that the applicant/petitioner be released on interim bail for a period of two weeks from the date of his release, subject to his furnishing a personal bond in the sum of Rs.10,000/- with one surety of the like amount to the satisfaction of the concerned Jail Superintendent/ concerned Court/Duty J.M./Link J.M. and subject to the following conditions :- i) The applicant shall not leave the Delhi NCR without prior permission of the concerned Court;
ii) At the time of furnishing bail bond, the applicant would specify the mobile number, which he undertakes to keep operational during the period of his release; iii) In case of change of residential address or contact details, the applicant shall promptly inform the same to the concerned Investigating Officer as well as to the concerned Court. iv) The applicant shall not directly/indirectly try to get in touch with the complainant or any other prosecution witnesses or tamper with the evidence;
v) The applicant shall surrender upon expiry of the interim bail period.
