By way of present bail application, the applicant seeks regular bail in FIR No. 262/2024 registered under Sections 307/34/341/147/148/149 IPC and Sections 25/54/59 of the Arms Act at P.S. Anand Parbat, Delhi. 2.
Learned counsel for the applicant submits that the applicant is in custody since 18.07.2024 and the charge-sheet stands filed in the present case.
On merits, it is stated that as per the case of the prosecution, it is the co-accused, i.e., CCL 'H' who has inflicted the stab injuries to the injured with a knife. Learned counsel further submits that the role of the present applicant is only stated to be not letting the injured escape from the spot. It is also stated that the incident has been captured by the CCTV footage in which the applicant is not even visible.

The bail application is opposed by the Ld. APP for the State, who submits that the applicant's role is distinct inasmuch as preventing the injured from escaping. It is also submitted that the applicant is involved in another case being FIR No. 23/2022 registered under Sections 323/452/147/148/149 IPC at P.S. Patel Nagar, Delhi. 4.
At this stage, ld. counsel for the applicant, on instructions, submits that the applicant is already on bail in the aforesaid FIR. 5.
Considering the role of the present applicant as well as the fact that the stab injuries were caused by the co-accused, CCL 'H' and the further fact that the applicant is statedly in custody since 18.07.2024, this Court deems it fit to release the applicant on regular bail, subject to him furnishing a personal bond in the sum of Rs.25,000/- with one surety of the like amount to the satisfaction of the concerned Jail Superintendent/concerned Court/Duty Judicial Magistrate and subject to the following further conditions :- i) The applicant shall not leave the NCR without prior permission of the concerned Court.
ii) The applicant shall provide his mobile number to the Investigating Officer on which he will remain available during the pendency of the trial. iii) In case of change of residential address or contact details, the applicant shall promptly inform the same to the concerned Investigating Officer as well as to the concerned Court.
iv) The applicant shall not directly/indirectly try to get in touch with the complainant or any other prosecution witnesses or tamper with the evidence. v) The applicant shall regularly appear before the concerned Court during the pendency of the trial.

The bail application is disposed of in the above terms. 7.
Copy of the order be communicated to the concerned Jail Superintendent for information and necessary compliance. 8.
Needless to state that the observations made hereinabove are only for the purpose of disposal of present bail application and which shall not have a bearing on the trial of the case.
