% 15.03.2018 Vide the present application, the applicant seeks grant of anticipatory bail in FIR No. 168/17, PS Badarpur, under Section 420/406/34 of the Indian Penal Code, 1860 submitting to the effect that he wants to make the entire payment and shall also hand over the plot in question. On behalf of the State, it has been submitted that vide proceedings dated 26.02.2018 FIR No. 168/17, PS Badarpur, the applicant has already been declared a proclaimed offender.

In view thereof, the application in view of the verdicts of State of Madhya Pradesh Vs. Pradeep Sharma (2014) 2 SCC 171 and Lavesh Vs. State (NCT of Delhi) (2012) 8 SCC 730 is not maintainable and is declined. ANU MALHOTRA, J MARCH 15, 2018/MK
