The petitioner impugns the order dated 24.10.2024 passed by the learned District Judge-04, South-East, Saket Courts, Delhi in CS DJ 490/2016 titled "Ahmadiah Contracting and Trading Co. KCSC vs. Reynold India Pvt. Ltd."

The petitioner is stated to be the defendant in the Suit for Recovery filed by the plaintiff.

Learned District Judge vide impugned order dated 24.10.2024 closed the defendant's Evidence and listed the case for final arguments. 4.

The learned Trial Court in its order has noted that the matter was pending for Defendant's Evidence ["DE"] since 2019 and defendant sought adjournments on one pretext or the other and was not able to lead the DE. 6.
The Court while taking note of the aforesaid conduct of the petitioner, closed the DE, on account of delay.

The impugned order reveals that the petitioner could not examine any witness despite having been granted several adjournments in the last five years. The Court does not find any illegality or impropriety in the orders of the learned Trial Court. There is no merit in the petition. The present petition is accordingly dismissed.
