The present petition has been filed for removal of the impugned registration of trademark/ label under registration no. 5365964 in Class 1 from the Register of Trade Marks. 2.
Learned counsel appearing for the respondent no.1 submits that respondent no.1 has already adopted a new mark as follows: The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Learned counsel appearing for the petitioner submits that he has no objection to the new mark adopted by the respondent no.1. 4.
Considering the submissions made before this Court, the registration of the label under registration no. 5365964, in Class 1, is hereby cancelled.

Respondent no.2, i.e., Registrar of Trade Marks, is directed to carry out the necessary rectification in its register. 6.
Respondent no.1 is at liberty to approach the respondent no. 2, i.e., Registrar of Trade Marks, for registration of its new mark, in accordance with law.

With the aforesaid directions, the present petition is disposed of. 8.
