The present proceedings are instituted on behalf of the petitioners seeking quashing of FIR No. 1023/2016 registered under Sections 323/354B/509/427/34 IPC at Police Station Vasant Vihar, New Delhi on the ground that the parties have amicably settled their disputes. 2.
As per the allegations levelled in the FIR, the petitioners misbehaved and had a physical altercation with respondent No.2 and her family members.

Mr. Nawal Kishore Jha, learned APP for the State, on instructions, submits that the petitioners are the only accused persons and respondent No. 2 is the only complainant/victim in the present case. He further submits that in the present case charge sheet has already been filed. was also given beatings. He further states that a cross FIR being FIR No.1022/2016 registered under Sections 323/354B/509/324/427 IPC is also pending between the parties.

Learned counsel for the petitioners submits that the present FIR was registered due to misunderstanding and with the intervention of the elders, close relatives and well-wishers, the parties have amicably settled their disputes vide Compromised Deed dated 04.11.2024, a copy whereof has been placed on record. In terms of the said settlement, respondent No. 2/complainant is now left with no claim or grievance against the petitioners. 5.
The petitioners are present in person in the Court and are identified by their counsel as well as the Investigating Officer/ SI K.M. Barti PS Vasant Vihar, New Delhi. Respondent No. 2 is also present in the Court along with her husband Mr. Sanjay Yadav and both are also identified by the Investigating Officer. The parties undertake to cooperate with each other in quashing the FIR No.1022/2016.

The petitioners have shown remorse for their conduct and they undertake not to repeat the same in future. Respondent No. 2 and her husband also state that they have entered into the aforementioned settlement agreement out of their own free will, volition and without any coercion. They further state that they have no objection if the present FIR and consequent proceedings are quashed.

The parties shall remain bound by the statements made in Court today.

In view of the above facts and since no useful purpose will be served in continuance of the proceedings, it is directed that the aforesaid FIR and the consequent proceedings arising therefrom are hereby quashed. With the above directions, the petition is disposed of along with pending application.
