After some arguments, learned counsel for the appellant submits that since the appeal has been filed without arraying the Legal Representatives of the deceased appellant as also of the deceased respondent, he may be granted leave to withdraw the present appeal with liberty to initiate appropriate proceedings as per law.

The appeal, alongwith the pending application, is accordingly dismissed as not pressed with liberty as prayed for. We, however, make it clear that the said liberty being granted to the appellant shall not be construed as this Court having expressed any opinion on the maintainability of a fresh appeal, if any, as may be filed by the appellant.
