Learned counsel for the respondent enters appearance. He submits that the petitioner previously filed a petition in this Court, seeking relief/s identical to those sought in the present petition. In this regard he draws attention to an order dated 05.06.2023 passed in O.M.P.(I)(COMM.) 193/2023 filed by the petitioner, whereby this Court rejected the prayer/s sought by the petitioner qua the very same bank guarantee with regard to which the present petition has been filed. An appeal filed against the said order was also been dismissed by the Division Bench of this Court. 2.

The conduct of the petitioner in omitting to disclose the aforesaid facts, and yet seeking urgent interim relief/s is reprehensible. 3.

Confronted with the above situation, learned senior counsel for the petitioner submits, on instructions, that the petitioner seeks to withdraw the present petition.
