O R D E R

The present application has been filed seeking regular bail in a case arising out FIR No. 460/2023 dated 01.07.2023, registered at P.S. New Ashok Nagar, Delhi, under Sections 377/451 of Indian Penal Code, 1860 (IPC) and Section 4 of Prevention of Children from Sexual Offence Act, 2012 (POCSO).

The applicant was arrested on 01.07.2023 and continues to be in incarceration since then.

After framing of charges, the victim boy, as well as one material witness i.e. Mr. Jitender Kumar, (alleged eye witness), have already entered into witness box and, therefore, there is no possibility of applicant attempting to threaten or influence any material public witness. 4.

The Nominal Roll is on record which does not indicate any other involvement of any nature whatsoever.

and, in view of the abovesaid incarceration period, the fact that the victim and material public witness have already been examined and keeping in mind the overall facts of the case, albeit, without making any observation on the merits of the case, the applicant is, hereby, directed to be released on bail on her furnishing personal bond in a sum of Rs. 15,000/- with one 'local' surety of like amount, subject to the satisfaction of learned Trial Court/CJM/Duty Magistrate with the following conditions: - i.

Applicant shall not try to contact and influence any witness, directly or indirectly.

ii.

Applicant shall provide his Mobile Number to the concerned I.O and shall ensure that such Mobile Number remains active and operational, till the disposal of the case by the learned Trial Court.

iii.

Applicant would report to concerned SHO/IO every first Sunday of every month at 11:00 A.M. till trial is over. iv.

Applicant would provide the address and the learned Trial Court would be at liberty to get the address verified before the accepting the bonds.

Application stands disposed of.

A copy of this order be sent to the concerned Court and also to the Jail Superintendent for necessary information and compliance.
