The Petitioner is recognized as a Pre-Shipment Inspection Agency authorised by the Directorate General of Foreign Trade1 to inspect metallic scrap imports. As part of their operations, the Petitioner ensure compliance with legal and environmental safety standards by excluding hazardous, toxic, radioactive, or explosive materials.

The Petitioner's grievance arises from communications dated 16th September, 2024 and 26th September, 2024, reducing the Petitioner's area of operation. Aggrieved by the said communications, the Petitioner has submitted their representation on 17th September, 2024 followed by reminder dated 2nd October, 2024 to the DGFT, however, no decision has 1 "DGFT"

Considering the above, without going into the merits of the case, the Court is of the opinion that the Respondents must examine the Petitioner's representation on the grounds urged therein, and take a decision thereon. 4.

Accordingly, the present writ petition is disposed of with a direction to the Respondents to consider the Petitioner's representation referred above, within a period of three weeks from today, and take a decision thereon and intimate the same to the Petitioner. 5.

The Court has not made any comments on the merits of the case. 6.
