Petitioner had availed loan facility from respondent no. 2/IndusInd Bank Limited for purchasing a vehicle. In terms of such loan agreement, he was provided with a vehicle and was to repay the loan amount in EMIs. 2.

It seems that there was some financial indiscipline which, eventually, resulted in repossessing of the vehicle by the respondent no. 2 and it is in the aforesaid factual backdrop that present petition has been filed seeking direction to the respondent no. 2 to handover the vehicle with all its papers. 3.

It is not clear as to on what basis, the Govt. of NCTD of Delhi through its Chief Secretary has been made party in the present writ petition. 4.

Learned counsel for respondent no. 2 appears on advance notice and submits that writ petition is, even otherwise, not maintainable against them. However, when asked, learned counsel for respondent no. 2 submitted that they would have no objection if the present writ petition is treated as a representation to the respondent-bank and they would consider the same in accordance with law and would dispose of the same within a period of four weeks. It is also submitted that petitioner should also come forward with reasonable proposal so as to reach amicable settlement of the matter. 5.

Petitioner is also present in the Court and learned counsel for petitioner has no objection if the present petition is accordingly disposed of. 6.

In view of the above, without commenting over the merits of the case and without touching upon the aspect of the maintainability of the present petition, the present petition is disposed of with direction to the respondent no.2 to treat it as representation and to dispose of the same in accordance with law within four weeks from today.
