O R D E R

% 27.03.2019 The present application has been filed under Section 438 of Code of Criminal Procedure seeking Anticipatory Bail in case FIR No. 488/2017 under Sections 498A/406//377/354/34 of the Indian Penal Code registered at Police Station K. N. Katju Marg, Delhi. Vide order dated 11.03.2018, interim protection was granted to the petitioner subject to payment of Rs.15,00,000/- (Rupees Fifteen Lac Only) to the complainant, which stood paid. In addition to the said amount, the petitioner further agreed to pay Rs.5,00,000/- to the complainant in two equal instalments, which also stood paid. Vide order dated 27.11.2018, interim protection granted to the petitioner was extended subject to payment of Rs.2,00,000/-.

Complainant is present in Court today. Petitioner has handed over two demand drafts No. 796458 and 796461 dated 20.03.2019 and 26.03.2019 respectively for Rs.50,000/- each and demand draft No. 796460 dated 25.03.2019 for Rs.1,00,000/-, to the complainant in Court today. All demand drafts are in favour of 'Rupanshi Gupta' drawn on Punjab National Bank, Sanjay Gandhi Transport Nagar, Delhi.

A matrimonial discord between the parties has led to the registration of the FIR in the instant case. Efforts are being made to explore the possibility of an amicable settlement between the parties. In these circumstances, interim protection granted to the petitioner vide order dated 16.03.2018, is hereby confirmed. It is hereby directed that in the event of arrest till filing of the chargesheet, the petitioner, Vishwas Oberoi be released on bail on the following terms and conditions:- (i) That the petitioner shall furnish a personal bond in the sum of Rs.25,000/- with one surety of the like amount subject to the satisfaction of Arresting Officer/SHO concerned;

(ii) That the petitioner shall cooperate with the investigation and make himself available for interrogation by police officer, as and when required;

In case of default of aforementioned condition, the State is at liberty to take appropriate recourse in accordance with law.

Before parting with the order, it is relevant to mention that nothing contained in this order shall be construed as an expression on the merits of the case.

Application stands disposed of.
