Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed on behalf of the Petitioners seeking quashing of FIR No. 0379/2024 registered under Sections 115(2)/126(2)/351(3)/79/77/3(5) BNS at P.S. Lajpat Nagar, Delhi and all the proceedings emanating therefrom in terms of the Memorandum of Understanding dated 19.08.2025. 2.
On advance Notice, learned APP has appeared and accepted the Notice on behalf of the State. Learned Counsel for the Respondent No. 2 has appeared and accepted the Notice.

It is stated that on 02.11.2024, on the basis of complaint filed by the Respondent No.
2, 0379/2024 was registered under Sections 115(2)/126(2)/351(3)/79/77/3(5) BNS at P.S. Lajpat Nagar wherein the Petitioners were implicated.

It is submitted that with the intervention of family members, relatives and well wishers, Petitioner and Respondent No.2 have resolved their disputes and arrived at an amicable settlement, terms whereof have been recorded in Memorandum of Understanding dated 19.08.2025. 6.
The Complainant/Respondent No. 2 submits that the Petitioners are her husband and parents-in-law and she lodged the complaint due to a fight took place on the day of incident but now the matter has been amicably settled and she has gone back to her matrimonial home on 19.08.2025. She affirms that she is happily living together with Petitioner. 7.
It is submitted by the parties that they have arrived at a settlement without any force, coercion and undue influence and pressure and they have signed the Memorandum of Understanding dated 19.08.2025 voluntarily with their wish and will.

Learned Counsel for Petitioners submits that the parties have been happily living together for the last two months and no grievance against each other survives and since Respondent No. 2 has already made a statement before the Court that she does not want to pursue the proceedings in FIR No. 0379/2024, the present Petition be allowed and FIR registered against the Petitioners be quashed.

In view of the fact that the FIR in question was premised upon a matrimonial dispute between Petitioner and Respondent No.2, which has been amicably resolved in term of Memorandum of Understanding dated 19.08.2025 and the fact that parties have been living together for last one year and also that Respondent No. 2 has given 'no objection' to the quashing of FIR, no fruitful purpose would be served in continuing with the proceedings The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Consequently, 0379/2024 registered under Sections 115(2)/126(2)/351(3)/79/77/3(5) BNS at P.S. Lajpat Nagar and proceedings emanating therefrom are hereby quashed.
