Officer (IO) from Police Station Moti Nagar, Delhi. 5.
Brief facts of the case are that the marriage between petitioner no. 1 and respondent no. 2 was solemnized at New Delhi on 03.12.2017, in accordance with Hindu rites and ceremonies. It is stated that due to various differences, disputes and issues had arisen between the petitioners and respondent no. 2. Upon the complaint by respondent no. 2, the present FIR came to be registered against the petitioners. It is stated that the parties have now amicably settled their dispute before the learned Additional Sessions Judge-09, Tis Hazari Courts, Delhi vide Settlement dated 29.03.2022. 6.
On a query made by this Court, respondent no. 2 who has been identified by the IO, has categorically stated that she has entered into compromise out of her own free will and without any pressure, coercion or threat. A demand draft bearing No. 052853, dated 24.10.2025, drawn on State Bank of India, for an amount of ₹21 lakhs has been handed to respondent no. 2 by the learned counsel appearing for the petitioners towards the balance settlement amount. Therefore, respondent no. 2 has no objection if the present FIR is quashed.
7.
In view of the above facts that the parties have amicably resolved their differences of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 8.
Accordingly, FIR bearing No. 285/2015, registered at Police Station Moti Nagar, Delhi for the commission of offences punishable under Sections 498A/406/34 of the IPC and all consequential proceedings emanating The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
