O R D E R

This is an application seeking grant of regular bail to the applicantaccused in FIR No. 0373/2022, under Section 20B of NDPS Act, registered at PS Narela Industrial Area.

As per the FIR, the applicant was found in possession of 1.64 kg of ganja, which is an intermediate quantity.

The applicant has been in custody for more than 4 months and 21 days.

It is stated by Ms. Dalal, learned APP that in the present case, the applicant while on bail committed another offence under the NDPS Act. 5.
I have heard learned counsel for the parties. 6.
In the present case, the applicant has already spent more than 4 months in custody.

In the other NDPS case, namely FIR No. 279/2024, he has already been granted bail on 21.10.2024 by this Court. 8.
The quantity of ganja with the applicant was an intermediate quantity. 9.
The custodial interrogation of the applicant is already over. 10.
The applicant belongs to the poor strata of the society. 11.
Till date, only 4 witnesses have been examined out of 14 witnesses and it seems that the trial in the matter will take some time. 12.
For the said reasons, I am inclined to allow the application. 13.
The applicant is directed to be released on bail on the following terms and conditions:
(a) The applicant shall furnish a personal bond in the sum of Rs. 10,000/- (Rupees Ten Thousand Only) with one surety of the like amount to the satisfaction of the concerned Trial Court; (b) The applicant shall join investigation as and when called by the concerned IO, and the applicant shall appear before the concerned Court as and when the matter is taken up for hearing; (c) The applicant shall provide his mobile number to the concerned IO, which shall be kept in working condition and switched on at all times. The applicant shall also provide his permanent residential address and in case of change of residential address or contact details, the applicant shall promptly inform the same to the concerned IO as well as to the concerned Court; (d) The applicant shall not leave the country without permission of the concerned Court during the bail period and surrender his passport, if any, at the time of release before the concerned Court.

In case there is any other FIR registered against the applicant, the respondent shall be at liberty to file an application for cancellation of bail. 15.
