Counsel for the Petitioner submits that the Petitioner has been falsely implicated in the present case due to a personal dispute arising from a failed relationship. It is contended that the chargesheet, the recorded statements, and the allegations stem primarily from personal vendetta and are essentially civil in nature, which have been given a criminal colour. It is further submitted that none of the allegations made in the subject FIR disclose the offences for which the chargesheet has been filed. Counsel also points out that there are several contradictions in the statements, and that the statement of the prosecutrix recorded under Section 164 CrPC contains material improvements over her earlier statements. Additionally, inconsistencies between the FIR, the MLC report, and the Section 164 statement raise serious doubts regarding the credibility of the allegations. While all these grounds are pertinent, counsel for the Petitioner, at this stage, very fairly seeks leave to withdraw the present petition, with liberty to raise all the grounds urged herein before the Trial Court at the stage of arguments on the point of charge.

Leave and liberty, as prayed for, are granted. 4.

Dismissed as withdrawn.

The pending application also stands disposed of. 6.

The Petitioner shall be at liberty to raise all grounds urged in the present petition, as well as any other grounds available to him in law. 7.

The Trial Court shall consider all such submissions in accordance with law.

In the event the decision of the Trial Court is not favourable to the Petitioner, he shall be at liberty to pursue all appropriate remedies available to him in law.

The Court has not commented on the merits of the case. All rights and contentions of the parties are left open.
